Barney the Dinosaur Contest Rules
Participation in the Barney the Dinosaur Contest (the “Contest”) constitutes each applicant’s and contestant’s full and unconditional agreement to, and acceptance of, these Rules. All decisions of Community Television of North Carolina, LLC (“Sponsor”), are final and absolute and not subject to inquiry or appeal. The Contest may be temporarily postponed or discontinued at any time without prior notice.

Who Can Enter
1.Entrants must be legal U.S. residents who reside in North Carolina, Virginia or Tennessee who are 18 years of age or older and have lawful access to the Internet and a valid e-mail address.
2.Employees of Sponsor, its affiliated companies, advertising and promotion agencies, and the immediate family members of each are not eligible to participate or win. The term "immediate family" includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as "in-laws," or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related. All entries received from ineligible entrants will be void.
How To Enter
3.No purchase is necessary to enter or win. Only one entry per household/e-mail address. The giveaway begins at midnight EST on March 7, 2011 and all entries must be received by 11:59 pm EST on March 11, 2011. Show dates are March 18-19, 2011. Sponsor reserves the right to extend or to limit the Contest Period at its sole discretion.
4.Sponsor will promote on Facebook to encourage people to go to www.MyFOX8.com to enter to win. To enter, access the online entry form at www.MyFOX8.com. Entry constitutes an assignment to Sponsor of all intellectual property rights in the entry materials, if any. Except where prohibited by law, entry constitutes permission to use winners’ names, hometowns, likenesses, and photographs for all purposes, including online posting, and/or any advertising and publicity without additional compensation, credit or right of review or approval.
The Prize(s)
5.Eight (8) winners will be selected by random drawing from among valid entries on or about March 11, 2011.
6.Each winner will receive a family 4-pack to the Barney the Dinosaur show at the Greensboro Coliseum. The approximate retail value of each prize is $80.00. Each ticket is valued at $20 (a family 4-pack = $80). The winners must to bring the voucher to the box office to redeem their tickets.
7.Winners will be notified by e-mail on or about March 11, 2011. Winners will be required to complete, sign and return a Certification of Eligibility and Release within seven (7) days of the date of notification or they will be disqualified. If a winner cannot be reached, or if a winner does not return the Certification of Eligibility and Release within the designated time period, the prize will be awarded to an alternate winner selected by random drawing.
8.Prizes cannot be redeemed for cash or substituted for any other items by the winners. The winners cannot assign or transfer prize. Sponsor reserves the right to substitute a comparable prize of like or greater value, including cash, for any prize, for any reason.
9.The winners is responsible for all local, county, state, and federal taxes on prizes based on the value of the prizes set forth in these rules.
10.Only one prize will be awarded per household. Individuals are eligible to win only one prize within any 90-day period, regardless of the number of giveaways entered. Winner must claim the prize by March 18, 2011 or the prize will be forfeited.
Odds of Winning; Miscellaneous
11.Odds of winning depend on the number of correct entries received.
12.These giveaway rules are available at www.MyFox8.com, and Monday through Friday during normal business hours at WGHP, 2005 Francis St., High Point, NC 27263 through March 18, 2011.
13.For a list of prize winners, send a separate, self-addressed, stamped envelope after March 18, 2011 to: WGHP, 2005 Francis St., High Point, NC 27263.
14.This giveaway is subject to all applicable laws and regulations and is void where prohibited or restricted by law, including without limitation, in jurisdictions requiring registration, filing, trust account, or posting of a bond, or any other requirements or disclosures that are not expressly satisfied by these rules. Sponsor is not responsible for typographical or other errors in the printing, offering, or administration of the giveaway, or in the announcement of the prize.
15.By entering, participants represent that they are eligible, and agree (a) to be bound by these rules and the decisions of the judges, (b) to release Sponsor, its parent, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, losses, or damages of any kind caused by any prize or resulting from acceptance, possession, use, or misuse of any prize, and (c) to Sponsor’s use of entrants’ personal information as described in Sponsor’s Privacy Policy located at www.MyFox8.com.
16.Any valuation of the prize(s) stated above is based on available information provided to Sponsor, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. All taxes, including federal, state and local taxes, are the sole responsibility of winner. Each winner must provide Sponsor with valid identification before any prize will be awarded.
17.Sponsor is not responsible for error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or technical, network, telephone equipment, electronic, computer, hardware, or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry, winner(s) or other giveaway information by Sponsor or entrants for any reason whatsoever. Sponsor is also not responsible for any injury or damage to any entrant’s or any other person’s computer related to or resulting from playing or downloading any materials in the giveaway or for entries that are late, misdirected or incomplete. All entries become the property of Sponsor and will not be returned. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE GIVEAWAY IS A VIOLATION OF THE CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right to cancel, at its sole discretion, the giveaway if it becomes technically corrupted.
18.LIMITATION OF LIABILITY: By participating, competitors agree: (a) to the Official Rules and decisions of Sponsor, which shall be final in all respects; (b) to release, hold harmless, and indemnify Sponsor and its respective affiliates, parents, subsidiaries, advertising and promotion agencies, officers, directors, employees, representatives, and agents from all claims, actions, liability, injuries, losses or damages of any kind to persons, including but not limited to death or property damage resulting in whole or in part, directly or indirectly, from participation in the Contest or any Contest-related activity whether presently known or unknown, foreseen or unforeseen; (c) that the foregoing parties have neither made nor are in any manner responsible or liable for any warranty, representation or guaranty, expressed or implied, in fact or in law, relating to any prize. Sponsor, Local TV LLC, and their advertising and promotion agencies are not responsible for cancellations, postponements, or delays. Sponsor shall have the sole discretion to administer the Contest and interpret and apply these Rules. Anyone using fraudulent means to participate in and/or win the Contest will be subject to disqualification. Sponsor, reserves the right to disqualify any contestant at any time, for any reason, including, without limitation, language, lyrics, activities or behavior deemed inappropriate. Other than the prizes received by the Grand Prize winner, no contestant shall be entitled to receive any wages, benefits, fees or other compensation whatsoever as a result of participating in the Contest. Any expenses incurred by the applicant during the application process, including but not limited to, postage, shipping and materials preparation (videotape, photos, etc.) are the sole responsibility of each applicant and neither Sponsor nor Local TV LLC will issue reimbursement for any expenses. All contestants and winners agree, by participation in the Contest, to submit to the personal jurisdiction of the courts of North Carolina. All courts of North Carolina shall govern this Contest, without regard to North Carolina’s choice of law rules. The courts of North Carolina shall be the exclusive forum for any dispute regarding any Rule or activity associated with the Contest.
UNDER NO CIRCUMSTANCES SHALL SPONSOR BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES, ATTORNEYS’ FEES, OR ANY OTHER DAMAGES.
