HARDEE’S CHECKERED FLAG CHALLENGE CONTEST RULES
NO PURCHASE NECESSARY TO ENTER OR CLAIM A PRIZE. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING.
VOID WHERE PROHIBITED OR OTHERWISE RESTRICTED BY LAW.
1.HOW TO ENTER:
Viewers must register online at www.MyFOX8.com between, generally, 5 a.m. EST on March 16, 2011 and 12:00 a.m. EST on May 14, 2011. Go to the Contest tab and look for the link to the Hardee’s Checkered Flag Challenge Contest or use www.MyFOX8.com/nascar. Incomplete entries will be disqualified. Entrants may be required to become registered users of the website.
For an entry to be deemed eligible the entrant must correctly guess the winner of each Sunday’s (“Race Day”) NASCAR race and each weekly entry must be submitted prior to 12 p.m. EST on Race Day. No entries will be accepted from 12 p.m. EST on Race Day until 5 a.m. EST on the following Monday. At that time, registration for entries will reopen for the next upcoming Race Day.
The Hardee’s Checkered Flag Challenge (“the Contest”) is open only to legal US residents at least 18-years old as determined by WGHP who reside in those portions of North Carolina, Tennessee and Virginia included in Television DMA Rank #46 as defined by The Nielsen Company. Employees of Hardee’s, WGHP (“the Sponsor”), and members of the immediate family of any such persons are not eligible to participate or win. The term "immediate family" includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as "in-laws," or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related. All entries received from ineligible entrants will be void.
3.ENTRY DEADLINES:
The Contest will begin, generally, at 5 a.m. EST on March 16, 2011 and end at 12:00 a.m. EST on May 14, 2011.
4.PRIZE(S):
Prize winners will be selected each Monday, after the preceding Sunday’s NASCAR race, beginning about March 21, 2011 for eight (8) consecutive, weekly races. Ten (10) total weekly winners will be randomly selected from the total number of eligible entries received each week. Each weekly winner will receive two certificates for Chicken Tenders. No entrant is eligible to win more than one time. The approximate retail value of the prize is $6.00. If less than ten (10) guess the winner, entries that correctly guessed the next driver(s) finishing closest to first round winners will be selected, until ten (10) people have won. If an entrant is not selected for a prize in one week, they must re-register in order to be eligible for subsequent weeks.
There will be one (1) Grand Prize winner selected from all of the eligible weekly winners chosen at 9am on or about May 16, 2011. The Grand Prize is four tickets plus a parking pass for the Coca Cola 600 on Sunday, May 29, 2011. The approximate retail value of the Grand Prize is $431.00. Costs of transportation and accommodations, if applicable, are the sole responsibility of the winners.
Winners will be notified online at www.MYFOX8.com, and by e-mail beginning on or about March 21, 2011, on the date the winner is chosen. Winners of the Chicken Tenders prize will receive their prize in the mail. GRAND PRIZE WINNER: To claim their prize, the winner must appear in person at the offices of WGHP within seven (7) days after being notified of winning. WGHP’s business office is located at 2005 Francis St., High Point, NC 27263. Visits must occur on weekdays and be between the hours of 9 a.m. and 5 p.m. EST. At the time of their visit, winners must present valid photo identification and complete a Certification of Eligibility and Release. Failure to do so will disqualify the winner. In the event a winner is disqualified, an alternate winner will be selected at random from the total remaining eligible entries.
Prizes cannot be redeemed for cash or substituted for any other items by any winner. Prizes are non-assignable and non-transferrable. The Sponsor reserves the right to substitute a comparable prize of like or greater value, including cash, for any prize, for any reason.
5. MISCELLANEOUS ITEMS:
COPY OF OFFICIAL RULES: Copies of the Official Rules for the Contest may be obtained by (i) logging onto www.MYFOX8.com or (ii) by coming to WGHP during normal business hours (8:30 a.m. – 5:00 p.m. EST).
PRIZE LIMITATION: Only one (1) total winner per household.
PUBLICITY RELEASE: Each entrant acknowledges that his/her entry in the Contest constitutes that entrant’s consent to use, publish, reproduce and for all purposes, including publicity, promotion and advertising, in any media (including without limitation, the Internet, television or offline promotions), each winner’s name, voice, likeness, and any portion thereof, each extending throughout the universe and in perpetuity without further compensation, credit or right of review or approval.
DELIVERY DISCLAIMER: WGHP disclaims all liability for the inability of a participant to complete or continue a telephone call due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond WGHP’s control, or otherwise. WGHP disclaims all liability for any delays, misdelivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. WGHP is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant's ability to participate in the Contest, and any injury or damage to entrant's or any other person's computer related to or resulting from participating in or downloading any information necessary to participate in the Contest.
TAXES: Any valuation of the prize(s) stated above is based on available information provided to WGHP, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. All taxes, including federal, state and local taxes, are the sole responsibility of winner.
NAMES OF WINNERS: For a list of prize winners, send a separate, self-addressed, stamped envelope to: WGHP, 2005 Francis St., High Point, NC 27263, or appear in person at that location between normal business hours (8:30 a.m. – 5:00 p.m. EST).
CONDITIONS: WGHP reserves the right, in its sole discretion, to cancel, terminate, modify or suspend this Contest or any portion hereof, or to disqualify any individual implicated in any of the following actions, if for any reason: (a) infection by computer virus, bugs, interruption in wireless calling devices or wireless service, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes which, in WGHP's sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, (b) the Contest or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper processing of entries per these Official Rules,
(c) the Contest becomes corrupted due to wireless calling service interruption for any reason, or (d) the Contest is otherwise not capable of running as planned. By entering, entrants represent that they are eligible and agree to be bound by and comply with the Official Rules and the decisions of the judges. Any entrant who attempts to tamper with this Contest in any way shall be disqualified. WGHP reserves the right to disqualify any entrant at any time, for any reason, including, without limitation, language, activities or behavior deemed inappropriate. By participating, entrants agree that the foregoing parties have neither made nor are in any manner responsible or liable for any warranty, representation or guaranty, expressed or implied, in fact or in law, relating to any prize. WGHP and their advertising and promotion agencies are not responsible for cancellations, postponements, or delays. Sponsor shall have the sole discretion to administer the Contest and interpret and apply the Official Rules.
INDEMNIFICATION AND HOLD HARMLESS: Entrants agree to release, hold harmless and indemnify WGHP and each of its parent, subsidiary companies, affiliates, divisions, franchisees, representatives, consultants, subcontractors, suppliers, distributors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, and their officers, directors, employees, shareholders and agents (collectively the “Released Parties”), from and against any and all claims, actions and/or liability for any injuries or death, loss or damage of any kind arising from or in connection with participation in and/or entry into the Contest or acceptance, delivery or use of any prize.
LIMITATION OF LIABILITY: The Released Parties are not responsible or liable for any incorrect or inaccurate entry information or other errors in the printing, offering or administration of the giveaway or in the announcement of the prize(s) and assume no responsibility for (i) any error, omission, interruption, defect or delay in operation or transmission at any website, or wireless calling service, interrupted or unavailable network, server or other conditions, (ii) failure of any entry to be received by the WGHP due to technical problems, telephone service problems, human error, or wireless calling service, (iii) communication line, hardware and/or software failures, malfunction of phones (including wireless phones/handsets), phone lines, other communications malfunctions, unavailable network connections, cellular equipment towers, telephone systems or wireless service, (iv) damage to any computer (software or hardware) resulting from participation in the Contest, or damage to mobile phone or other PDA device, (v) theft or destruction of, tampering with, unauthorized access to, or alteration of entries and/or entry information, or (vi) entries which are late, lost, stolen, damaged, illegible, and/or unintelligible (or any combination thereof). Any expenses incurred by the entrant during the application process, including but not limited to, postage are the sole responsibility of each applicant and the Sponsor will not issue reimbursement for any expenses.
UNDER NO CIRCUMSTANCES SHALL WGHP BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES, ATTORNEYS’ FEES, OR ANY OTHER DAMAGES.
ARBITRATION: Except where prohibited, entrants agree that any and all disputes, claims and causes of action arising out of or connected with this Contest shall be resolved exclusively by arbitration pursuant of the Rules of the American Arbitration Association then effective. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and WGHP in connection with the Contest shall be governed by and construed in accordance with the laws of the State of North Carolina, without giving effect to any choice of law or conflict of law rules or provisions (whether of North Carolina or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than North Carolina. The invalidity or unenforceability of any provision of these Official Rules remains in effect. In the event that any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
